NYC has a Local Law which requires parking structures to be regularly inspected by a New York State Certified Professional Engineer.
As of January 2022, NYC Local Law 126 of 2021 (Intro No. 2261-A) will require owners of parking structures to hire a New York State licensed and registered professional engineer who is also a Qualified Parking Structures Inspector (QPSI) to inspect the structure at least once every six years and file a report with the Department of Buildings documenting the results of the inspection that include:
• buildings, or portions of a building, used for parking or storing motor vehicles, including space inside or under a building
• open parking garages and enclosed parking garages as defined in the NYC Building Code.
What is a QPSI?
A Qualified Parking Structures Inspectormust have a formal certification from the state of New York and have a minimum of 3 years of structural engineering experience, pertaining to parking structures:
Structural Design
Design of Structural Repairs
Inspection & Structural Evaluation
Forensic Structural Engineering Assessments
The QPSI must submit a report to the Department that meets, at a minimum, the criteria listed in 1 RCNY §103-13 within 60 days after completing the assessment. Applicable fees must be paid at time of submission.
When do I have to file?
Manhattan Community Districts 1-7
January 1, 2022 – December 31, 2023
Remainder of Manhattan & Brooklyn
January 1, 2024- December 31, 2025
Bronx, Queens & Staten Island
January 1, 2027- December 31, 2027
